" Open Community" means the street and public space opening to city．Comparing with the " gated community"，the inner spatial characteristics have been changed and which have aroused the resident' s concerns about property rights．So，it' s of practical significance to interpret the practical ways of the open community from the perspective of space rights．As the most typical China' s community mode，" Court-yard" and " Residential-district" are both the form of local government transferring out the spatial rights，which caused the internalization phenomenon of spatial right. It means the returning of basic spatial right to local government from the open community. In the choosing of practical paths，from comparison between property mode and " land finance" mode，this article proposed the claim of strengthening the government' s control on urban space development，and discussed the main problems and feasible methods aiming at the " new-developing community" and the " infilled community"．
